Is CBD legal in Idaho? Today we’re exploring CBD Oil in Idaho|Updated Guidelines.

If you’ve been feeling confused about the legal status of CBD in the state of Idaho, you are not alone.

Rules and regulations do vary from state to state, and then there’s federal laws too!

Even though CBD became federally legal in 2018, up until April of 2021, low THC formulas remained illegal in Idaho, unless they contained zero THC. It’s still pretty strict.

Current CBD Laws in Idaho

In 2015, Idaho legislature was passed which legalized the use of CBD with more than 0.3% THC for epilepsy.

Epidiolex is an FDA-approved CBD oil, and was approved in 2018, and legal to prescribe in Idaho.

And according to previous state laws, CBD products are legal only if they contain zero THC and are derived from one of five parts of the cannabis plant:

  1. Mature stalks
  2. Fibre produced from stalks
  3. Oil or cake made from the seeds
  4. Any other compound, salt, mixture or preparation of the mature stalk
  5. Sterilized seeds incapable of germination

And in April of 2021, Governor Brad Little signed into law, a bill legalizing the production and transportation of hemp with up to 0.3% THC.

This made Idaho the last state to finally do so!

However, the new law does not allow selling to Idaho consumers hemp products containing any amount of THC.

But because of the lack of approval by the FDA in regards to medicinal value, CBD is only considered a nutritional supplement in this state.

What Is CBD?

CBD or Cannabidiol can come from both the marijuana and industrial hemp plant.

The difference between these two types of CBD, is that marijuana-derived CBD has a much higher percentage of THC (the psychoactive ingredient that gets you high).

While the hemp-derived CBD contains only traces of THC.

The same laws exist across the board in the USA – and to consume CBD legally, there must be no more than 0.3% THC.

Broad Spectrum simply means that there is zero THC ( the psychoactive compound that gets you ‘high’) and some terpenes are not extracted.

Since Idaho was a little behind on passing state laws, you can purchase CBD online if you’re having a tough time finding a good and reliable location or trustworthy source.

You can also purchase CBD online through specific websites, as long as the products contain less than 0.3% THC.

CBD Labelling Requirements:

According to the Industrial Hemp Policy, all hemp-derived products including CBD oil have to be labelled to comply with state and federal laws:

  • you must clearly identify hemp as an ingredient
  • identify and label CBD, as well as the amount of CBD if added as an isolate
  • include an FDA statement that they have not evaluated the product
  • must not contain any therapeutic, health or nutritional benefit claims

With this recipe, you can make your own CBD oil at home, replacing it with weed oil, and create your own CBD crispy potato chips!

Equipment

  • Oven
  • Baking tray
  • Parchment Paper
  • Potato Peeler
  • Seasonings
  • Paper Towel
  • Large Bowl
  • Oven Mitts

Ingredients

  • 1/2 cup Cannabis Oil
  • 2-4 Large Potatoes Or more if you have guests
  • 2-4 tbsp Seasoning Popcorn seasoning is great – this is optional
  • 2 tbsp Himalayan salt IF you are not using any other seasonings

Instructions

  • Preheat your oven to 400 degrees F and line a large baking sheet with parchment paper.
  • Peel your potatoes.
  • Cut your peeled potatoes into thin slices and spread them evenly on the baking sheet. Drizzle the cannabis-infused oil over them.
  • Cook the potato chips until they are golden brown. Around 15 minutes
  • Allow the potato chips to cool for about 5-6 minutes.
  • Toss your chips in a bowl with salt OR seasonings.
  • Enjoy!
